In 1994, Congress passed the General Aviation Revitalization Act (GARA). Under the terms of the Act, a plaintiff cannot sue the manufacturer of an aircraft or its component parts if the defective aircraft or component part is more than 18 years old. However, a plaintiff may sue if he or she can prove that the manufacturer withheld vital information from the FAA concerning the performance and maintenance of the aircraft and/or its component parts.
Also, GARA is retolled if a suspect component part is revised, replaced or updated within the 18 year period.
